Four Indicted for Aggravated Child Abuse

Four people have been indicted by the DeKalb County Grand Jury for aggravated child abuse, aggravated assault (4 counts), child neglect, and child abuse involving a 13-year-old.
Sealed indictments against Angel Anne Mager, Christopher Brian Mager, Rebecca Ann Yount, also known as Rebecca Ann Van Dyne, and Jesse Eugene Van Dyne were returned Monday, November 15. They will soon be arraigned in criminal court
The first count of the seven-count indictment alleges that “between June 12 & 13, 2021 these defendants did unlawfully and knowingly abuse a 13-year-old child and that such act of abuse, neglect or endangerment was especially heinous, atrocious or cruel, or involved the infliction of torture to the victim, thereby committing the offense of aggravated child abuse”.
The second count alleges that on June 12, 2021 Angel Anne Mager caused bodily injury to the child and that the assault involved strangulation or attempted strangulation.
Count three alleges that on or before May 30, 2021 Christopher Brian Mager caused the child to reasonably fear bodily injury while utilizing a deadly weapon.
Count four further alleges that between May 17 and June 6, 2021 Christopher Brian Mager caused serious bodily injury to the child.
Count five alleges that between May 17 and June 17, 2021, Angel Anne Mager and Christopher Brian Mager committed the offense of child neglect so as to adversely affect the health and welfare of this child.
The sixth count alleges that on June 13, 2021 Angel Anne Mager caused bodily injury to the child and that the assault involved strangulation or attempted strangulation.
Count seven alleges that on or about June 15, 2021 Christopher Brian Mager inflicted injury on the child thereby committing the offense of child abuse.
Two Charged in Theft of Bass Boat

Two people have been charged with theft of property over $2,500 after they were found in possession of a 17-foot bass boat reported stolen in October from the Red Bank area of Chattanooga.
30-year-old Haley Dawn Wright of Midway Road, Smithville is under a $7,500 bond and she will be in court December 9. Bond for 40-year-old Scotty Brian Heard of Spring City, Tennessee is $22,500. In addition to the boat, Heard is also charged with theft of property over $1,000 and vandalism of a 2006 Harley Davidson Road King motorcycle reported stolen from a location on Highway 70 in the Snow Hill area. His court date is also December 9.
The boat was found at Wright’s home on November 15.
On the day it was reported stolen in DeKalb County, October 13, Sparta Police spotted the motorcycle and stopped it. Heard, who was operating the bike, was arrested and taken into custody. The motorcycle, which was returned to the owner, had some damage and missing parts totaling $2,270.
65-year-old Jimmy Ray Driver of Allen Street, Smithville is charged with domestic assault. His bond is $2,500 and he will make a court appearance December 2.
Sheriff Ray said that on November 16 a deputy was dispatched to Shady Drive due to a possible domestic assault. Upon arrival the officer spoke with a woman who said that she and her boyfriend, Driver had gotten into an argument and that when she tried to leave the residence on Allen Street, he attempted to push her out the door and down the steps. When she got to the yard, Driver pushed her against the front of a vehicle placing both hands on her upper chest causing a skin tear and bruising as well as bruising on her left arm. In an effort to escape, the woman hit Driver in the face. He then backed up and threw her phone giving her enough time to grab the phone and leave by car.
39-year-old Josue Alberto Sosa Torres of Petty Road, Smithville is charged with domestic assault and a driver license violation. His bond is $5,000 and he will make a court appearance on December 16.
Sheriff Ray said that on November 21 a deputy was dispatched to Petty Road due to a report of a domestic disturbance. Upon his arrival the officer spoke with Torres and a woman. She reported that her boyfriend, Torres had hit her in the head and arms while they were driving to the residence on Petty Road. She had several bruises on her right arm as well as a possible broken bone in her arm and a scratch on her left arm. Her daughter witnessed the assault and gave a written statement. While at the scene Torres also showed the officer a fake identification card.
