Man Charged in Rape Case Enters Plea to Lesser Crime

A 69 year old man will soon learn how his sentence is to be served after entering a guilty plea to an aggravated assault charge last Thursday, November 4 in DeKalb County Criminal Court.

Walter Kenneth Tubbs was originally charged with rape for an offense committed on July 26, 2016 but he agreed to plea to the lesser charge of aggravated assault. He is facing a five year sentence to serve at least 30% but the manner of how he is to serve the sentence including the possibility of judicial diversion will be determined at a later sentencing hearing.

Tubbs was accused of having sex with a woman against her will at the victim’s residence on Smith Road. After the incident Tubbs allegedly apologized and pleaded for the woman not to press charges. He also called family members and apologized to them for what he had done, according to the arrest warrant at the time.

37 year old Terri Lynn Poss entered a plea to reckless endangerment and received a sentence of 11 months and 29 days suspended to supervised probation.

During an investigation of an underage drinking party on Smith Road April 13, 2019 Smithville police spotted someone toss a beer bottle from the driver’s side window of Poss’ car. The officer followed Poss to McDonald’s and asked her to step out of the vehicle. He smelled a strong odor of alcohol coming from Poss’ person and noticed that she was unsteady on her feet. Poss submitted to but performed poorly on field sobriety tasks. Poss informed the officer that she had consumed one Bud Light Platinum which was the same bottle the officer found on Smith Road that had been thrown from her vehicle.

47 year old Micah Daniel Murphy entered a plea to driving under the influence and received a sentence of 11 months and 29 days suspended to 48 hours to serve but was given 5 hours credit for time served. Murphy was fined $360 and will lose his driver license for one year. He must attend DUI school and participate with the MADD Impact Panel.




DeKalb GOP to Hold Primary to Select Nominees for Local Offices in May 2022

For the first time ever the DeKalb County Republican Party will be conducting a primary instead of a caucus next year to select nominees for county elected offices. The local GOP primary will coincide with the DeKalb County Democratic Primary on Tuesday, May 3, 2022.

Winners of both primaries will run in the August DeKalb County General Election along with any independents who may qualify.

According to local GOP Party Vice Treasurer Vester Parsley, members of the DeKalb County Republican Party Executive Committee met Saturday at the courthouse to make the decision official. The primary will be held for the offices of County Mayor, Sheriff, Trustee, County Clerk, Circuit Court Clerk, Road Supervisor, Register of Deeds, County Commission (Districts 1-7), County Constable (District 4- special election), and General Sessions Judge.

The DeKalb County Democratic Party, which historically holds a local primary to select nominees, will also be having a primary for the same offices on May 3, 2022. Both parties have notified the election commission of their intentions.

Primaries will also be held by both parties throughout the 13th Judicial District on May 3, 2022 to select nominees for the offices of District Attorney General, Public Defender, Chancellor, Criminal Court Judges, and Circuit Court Judges.

The election commission office will begin issuing candidate petitions for the May 3, 2022 primaries on Monday, December 20. The qualifying deadline is noon on February 17, 2022.

Kittens, kittens, and more kittens!

The DeKalb Animal Shelter has kittens galore ready to be adopted in time for the holidays.

Meet this week’s WJLE/DeKalb Animal Shelter featured “Pets of the Week” Piper, Petunia, Batman and Ace.

“These are adorable black and white kittens. We have had them since they were babies. Our shelter is packed full of kittens right now so we would love to find them a forever home for the holidays. They are super playful. Our special is $40 to adopt which includes spay and neuter charges as well as the costs of all their vaccinations and they can be micro-chipped upon request,” said Shelter Director Emmaly Bennett.
