Habitual Offender Found with ICE, Pills, and Marijuana

A man recently caught driving without a license was found with marijuana, meth, and pills in his vehicle.

36 year old Willie Ray Murphy of West Bryant Street, Smithville is charged with simple possession of a schedule VI drug (marijuana), possession of a schedule II drug (methamphetamine or ICE), possession of a schedule IV drug (clonazapam), driving while in possession of methamphetamine, and driving while license restricted. Murphy’s bond is $33,500 and his court date is August 16.

Sheriff Patrick Ray said that on July 9 a deputy was traveling south on Short Mountain Highway when he spotted Murphy operating a motor vehicle. Knowing that Murphy did not have a license, the officer turned around to make a traffic stop. Murphy pulled over, got out of the driver seat, and ran to a house where he entered through a back door. The deputy found in the vehicle a small clear container with what appeared to be meth or ICE (which weighed 7.4 grams), a small bag containing 20 yellow pills believed to be clonazapam, a green leafy substance believed to be marijuana (which weighed 3.1 grams), and a used glass pipe.

Murphy was convicted in 2009 as an habitual offender in Cumberland County. In 2014, he was convicted again for driving as an habitual offender in Smith County.

30 year old Mary Katherine Ross of Sparta is charged with a second offense of driving under the influence. Ross’ bond is $3,000 and her court date is August 23.

Sheriff Ray said that on Sunday, August 5 a deputy was called to Nashville Highway where a woman was found passed out in the driver seat of a vehicle with the engine running. Upon arrival the officer observed the woman, Ross slumped over behind the steering wheel. After waking her, the officer asked Ross to submit to field sobriety tasks.  She performed poorly on those exercises.  The officer learned that Ross has one prior DUI conviction which was in White County on October 21, 2014. She was placed under arrest.

Unless a special session is held before the end of the month, Smithville Mayor Jimmy Poss will not preside over another city council meeting before he leaves office August 31.

Mayor Poss’ last regular monthly meeting with the aldermen was scheduled Monday night, August 6 but could not be held due to the lack of a quorum. Aldermen Shawn Jacobs and Josh Miller, who is also the mayor-elect, were in attendance but Aldermen Jason Murphy, who is also leaving office, and Aldermen Gayla Hendrix, and Danny Washer were absent.

Mayor Poss seemed frustrated by the aldermen’s absence as he announced to the audience that the meeting could not be held.

The next regularly scheduled meeting is set for Monday, September 10. It will be the first for the new mayor Josh Miller and the new council which will be made up of Jacobs, Hendrix, Washer, and the newly elected member Brandon Cox. He is succeeding Alderman Murphy, who chose not to seek re-election.

One of the first major decisions by the new mayor and aldermen will be appointing someone to fill Miller’s position on the council. Miller still has two years left on his alderman term.

The regular monthly meetings of the Smithville Mayor and Aldermen are on the first Monday of each month at 6 p.m. at city hall but since Labor Day is the next meeting date, the mayor and aldermen already have it re-scheduled for September 10.

The ceremonial swearing in of the new mayor and aldermen is expected to take place at that meeting.

An unruly prisoner at the DeKalb County Jail is accused of assaulting a correctional officer.

32 year old Cory Wade Foster of Smithville is charged with disorderly conduct and assault. Foster’s bond totals $7,500 and his court dates are August 16 for the assault and August 23 on the disorderly conduct charge.

Sheriff Patrick Ray said that on Thursday, August 2 a deputy was dispatched to Liberty at Nashville Highway and College Street where a man was reported to be running through traffic causing hazardous travel conditions. Upon arrival the officer encountered the suspect, Foster who had a threatening demeanor toward the officer and bystanders there. Foster was taken into custody. The next morning at the jail, Foster struck a correctional officer in the head after he failed to heed the officer’s repeated verbal commands to enter his cell. Foster committed the assault as officers were trying to gain control of him.

A man who sold items stolen from a victim on Holmes Creek Road has been arrested after an investigation by a Sheriff’s Department Detective

46 year old Craig Anthony Hill of Holmes Creek Road, Smithville is charged with theft of property under $1,000. Hill’s bond is $1,000 and his court date is August 9.

Sheriff Ray said that on July 27, Hill sold a Stihl leafblower, an eight foot extension ladder, and a blue air compressor. The total value of the stolen items is $700.

29 year old Anthony Charlie Miller of Green Bay Wisconsin is charged with being a fugitive from justice. Miller’s bond is $75,000 and his court date is August 16.

Sheriff Ray said that on Thursday, August 2 Miller was found to be a fugitive from justice from the state of Wisconsin. Officials in Marathon County, Wisconsin plan to extradite Miller.
