Homebuilder charged with theft after failing to finish a contracted job

A man who entered into a contract with another to build a house but didn’t follow through on the plan has been charged with theft of property over $10,000.

55-year-old Gordon Ray Rackley of Sparta Highway Smithville is under a $15,000 bond and his court date is July 28.

Sheriff Patrick Ray said that on September 24, 2021, Rackley signed a contract to build a home for which construction materials were paid up front. Although construction began in February 2022 it was never completed. In March 2022, the victim noticed materials missing from the job site and sent a letter by certified mail to Rackley as well as the Tennessee Consumer Protection Division. Rackley responded to the letter stating he would pay back the money but has yet to do so. The reimbursement amount sought by the victim is $10,730.

37-year-old Nicholas Aaron Gordon of Woodbury is charged with driving under the influence. His bond is $3,500 and he will make a court appearance on July 28.

Sheriff Ray said that on July 10 a deputy was dispatched to the area of Sparta Highway in response to a vehicle accident. Upon arrival the officer spoke with Gordon, who had driven off into a ditch. Gordon had a strong odor of alcohol on him. His speech was slurred, and he was unsteady on his feet. Gordon submitted to but performed poorly on field sobriety tasks.

A passenger with Gordon, 39-year-old Alisha Beth Ford of Mount Herman Road, Smithville is charged with possession of methamphetamine with intent to manufacture, sell, or deliver. Her bond is $15,000 and she will make a court appearance July 28.

Sheriff Ray said that on July 10 while assisting another officer with a DUI arrest involving Gordon, a deputy spoke with Ford who was in the passenger seat. After he asked her to step out of the vehicle so that a search could be conducted, he found in the passenger side floorboard where Ford’s belongings had been a baggie of a crystal-like substance believed to be methamphetamine that weighed 1.85 grams.

The DeKalb County Fair returns for its annual weeklong run Monday through Saturday, July 11-16.

With the theme “Hometown Heroes This Fair is For You in 2022″, the 166th edition will feature another fun filled week of rides by B&K Carnival and many crowd-pleasing activities and events including the Demolition Derby, ATV/Motorcycle Racing, Super Truck & Tractor Pull, Pageants, the Lip Sync Battle, Car Show, Grill-Off and Ice Cream Contest, Poultry, Cattle, Goat, and Pet Show, Hay Decorating, and much more. Cash drawings will be held each night.

DeKalb Fair President Matt Boss said this year’s fair is dedicated to “Hometown Heroes”.

“The Fair Board decided that we wanted to recognize the Hometown Heroes of DeKalb County and dedicate each night of the fair to them including our fire departments, police departments,  DeKalb EMS,  sheriff’s department, military, highway patrol, rescue squad and other people we consider Hometown Heroes in DeKalb County,” said Boss.

The Tennessee Democratic and Republican parties will have primaries on Thursday, August 4th to select nominees for Governor, U.S. House of Representatives, Tennessee House of Representatives and State Executive Committeemen and Committeewomen.

Early Voting begins Friday, July 15 and runs through Saturday, July 30. Unlike the DeKalb County General Election and Municipal Elections, voters must declare in which state primary (Democratic or Republican) they intend to vote either during early voting or on election day.

The most hotly contested state primary race in DeKalb County is the 40th District State Representative Republican Primary battle between 14-year incumbent Terri Lynn Weaver of Lancaster and Smithville businessman Michael Hale. The winner will face Democrat Tom Cook of Silver Point in the November 8th Tennessee General Election. Cook is unopposed in the state Democratic Primary on August 4.

The 40th District includes all of DeKalb, Smith, Jackson, and Cannon Counties and a small portion of Wilson County.

The candidates on the State Primary Ballots August 4th are as follows:

GOP Primary: Incumbent Bill Lee

Democrat Primary: Carnita Faye Atwater of Memphis , Jason Brantley Martin of Nashville, and JB Smiley Jr. of Memphis

U.S. House of Representatives (6th District)

Tennessee House of Representatives (40th District)

Meanwhile the August 4 ballot will also feature 26 State Judicial Retention questions in which voters may vote to either “retain” or “replace” judges

Early voting times are as follows at the DeKalb County Courthouse in Smithville: Mondays 1 p.m. to 5 p.m.; Tuesdays 9 a.m. until 1 p.m.; Wednesdays 9 a.m. until 1 p.m.; Thursdays 2 p.m. to 6 p.m.; Fridays 9 a.m. until 1 p.m. and Saturdays 9 a.m. until Noon. Early voting will also be held again in the western part of the county on a limited basis. The DeKalb County Fairgrounds will be the site of early voting on July 19th from 3 p.m. to 5 p.m. and on July 25 from 9 a.m. until 11 a.m. Each early voting site is for any properly registered DeKalb County voter.
