Kirby Charged with Evading Deputies Twice and Assaulting One Officer

A Walling man who crashed his car and fled the scene following a law enforcement pursuit was apprehended two days later after assaulting another officer who was trying to arrest him.
48 year old David Wayne Kirby is charged in the first incident with evading arrest in a motor vehicle and failing to give immediate notice of an accident. His bond on those charges totals $6,000. In the second incident, Kirby faces another charge of evading arrest; resisting stop, frisk, halt, arrest, or search; criminal impersonation; and assault. Kirby’s bond on those charges is $16,000. He will make a court appearance on all charges October 25.
Sheriff Patrick Ray said that on Sunday, October 7 a deputy tried to make a traffic stop on a 2014 Smart car driven by Kirby. The officer activated his emergency lights and siren but Kirby failed to stop. The car went off the roadway and struck a fence, causing damage to the property. After the crash, Kirby left the scene.
Two days later on Tuesday, October 9, Kirby was confronted by another deputy who responded to Whorton Springs Road in reference to a suspicious person in the area. When asked to identify himself, Kirby gave the officer a name and date of birth, which was not on file with central dispatch. After further questioning by the officer, Kirby tried to flee. When the deputy grabbed him, Kirby resisted and punched the officer in the forehead. The deputy ultimately got control of Kirby and placed him in custody.
Cookeville Woman Charged in Burglary and Theft at Local Business

A Cookeville woman who allegedly participated in a burglary and theft at a local business last month has been charged in the case.
36 year old Rebecca Lynn Hembree is under a $25,000 bond on charges of burglary and theft of property and she will make a court appearance on November 1.
Sheriff Patrick Ray said that on Tuesday, September 11 Hembree acted for an accomplice as an accessory to a burglary and theft that occurred at a business on Smithville Highway. Items taken were an Apple Ipad, 8 Peak handheld radios, and $1,000 in cash. The total value of the stolen goods is $3,900. The accomplice has not yet been arrested.
Three Involved in Rear-End Crash

Three people were involved in a rear-end crash Monday morning on Highway 56 south near Young’s Nursery.
Trooper Sean Tramel of the Tennessee Highway Patrol said 22 year old Victor Roller was traveling south in a 2011 Toyota Tundra when he ran into the rear of a 2003 Chevy S-10 pickup truck, driven by 60 year old Kathleen Ellis who had stopped in the southbound lane to make a left turn. Ellis’ 12 year old granddaughter was with her.
Ellis was taken by DeKalb EMS to Ascension Saint Thomas DeKalb Hospital. Although he suffered a head injury, Roller refused transport from the scene to the hospital by EMS. The child was not hurt.
Roller was cited with failure to exercise due care and for not wearing his seatbelt.
Members of the DeKalb County Sheriff’s Department were also on the scene.
